Email Communications & Marketing Notice

1. Introduction
Jus Havens Ltd (“we”, “us”, “our”), trading as HAVENS ESTATES, is committed to communicating with you in a lawful, transparent, and respectful manner. This notice explains the types of email we send, the legal basis for each, how we collect and store your email address, and how you can manage your preferences or withdraw consent at any time.
This notice should be read alongside our Privacy Policy and Cookie Policy.
We are registered with the Information Commissioner's Office (ICO) for data protection purposes. We comply with the UK General Data Protection Regulation (UK GDPR), the Data Protection Act 2018, and the Privacy and Electronic Communications Regulations 2003 (PECR).
2. Types of Email We Send
2.1 Transactional / Service Emails
These are emails sent as a direct result of a service you have requested or a transaction you have entered into with us. Examples include:
- Confirmation of a contact form submission or viewing request
- Valuation request acknowledgements and appraisal reports
- Appointment confirmations and reminders
- Sales progression updates and milestone notifications
- RICS formal valuation report availability notifications
- Client portal account and notification emails
- Responses to direct enquiries or complaints
Legal basis: Contract (Art. 6(1)(b) UK GDPR) and Legal Obligation (Art. 6(1)(c) UK GDPR). Prior marketing consent is not required for transactional emails. These emails do not contain marketing content.
2.2 Marketing Emails
Marketing emails include property news, investment opportunities, market updates, development announcements, and general promotional content. We send marketing emails only where:
- You have given us your explicit prior consent (PECR Regulation 22(2)); or
- The “soft opt-in” exception applies: you are an existing client who enquired about or purchased a similar service, and you were given a clear opportunity to opt out at the time your details were collected and in every subsequent marketing email (PECR Regulation 22(3)).
Legal basis: Consent (Art. 6(1)(a) UK GDPR) or Legitimate Interests under the PECR soft opt-in exception.
Every marketing email we send includes a one-click unsubscribe link. You may withdraw consent at any time. Withdrawal will not affect the lawfulness of processing prior to withdrawal.
2.3 Property Alert Emails
Property alert emails notify you when a property matching your specified criteria becomes available on our listings. These are sent only where you have subscribed via our property alert form and confirmed your subscription via a double opt-in confirmation email.
- Subscription status moves from “pending” to “active” only after you click the confirmation link in the opt-in email.
- Confirmation links expire after 72 hours.
- You may pause, update your criteria, or unsubscribe at any time using the links in any alert email.
Legal basis: Explicit Consent (Art. 6(1)(a) UK GDPR, PECR Regulation 22(2)).
2.4 Customer Service Emails
These are emails sent in response to a specific question, complaint, or data subject request. They are one-to-one communications and are not marketing or promotional in nature.
Legal basis: Legitimate Interests (Art. 6(1)(f) UK GDPR) and/or Contract (Art. 6(1)(b) UK GDPR).

4. How We Collect Your Email Address
We collect your email address through the following channels:
- Contact form — when you submit an enquiry via our website
- Property alert subscription — when you register to receive matching property notifications
- Valuation request — when you request a market appraisal or desktop valuation
- Viewing request — when you book a property viewing appointment
- Client portal registration — when you create a client account
- Direct communication — when you contact us by email directly
At every collection point, we display a disclosure notice explaining how your data will be used. Where marketing consent is sought, it is presented as a separate, clearly labelled, optional checkbox. We record the timestamp, IP address, source URL, and the verbatim consent text shown at the time of collection.
5. Consent Records
Where your consent is the legal basis for sending email, we maintain a secure consent record that includes:
- The date and time consent was given
- The exact consent wording presented to you
- The source form or page URL
- Your IP address (for accountability purposes)
- The email address to which consent applies
Consent records are retained for six (6) years after consent is withdrawn or the record becomes inactive, in accordance with our accountability obligations under Art. 5(2) UK GDPR. You may request a copy of your consent record at any time.
6. Data Retention
We apply the following retention periods to email-related data:
- Transactional email logs: Retained for 7 years for accounting and regulatory compliance purposes.
- Marketing consent records: Retained for the duration of the marketing relationship and for 6 years following withdrawal of consent.
- Property alert subscriptions: Active while your subscription is active. Suppressed records retained for 6 years for compliance purposes.
- Suppression records: Retained indefinitely to prevent recontacting individuals who have opted out.
7. Email Tracking
Some emails we send may include a tracking pixel or similar technology that tells us whether the email has been opened. We use this information solely to assess the effectiveness of our communications and to improve the quality of future emails.

8. Your Rights
Under UK GDPR and PECR, you have the following rights in relation to our email communications:
- Right to withdraw consent: You may withdraw your marketing or property alert consent at any time by clicking the unsubscribe link in any email we send, or by contacting us directly. Withdrawal does not affect processing prior to withdrawal.
- Right of access: You may request a copy of the personal data we hold about you, including your consent records and email subscription history.
- Right to erasure: Subject to our legal obligations (e.g. AML records), you may request deletion of your personal data.
- Right to object: You may object to our processing of your data based on legitimate interests.
- Right to rectification: If your data is inaccurate, you may request correction.
- Right to lodge a complaint: If you are unhappy with how we handle your data, you have the right to complain to the Information Commissioner's Office (ICO) at ico.org.uk.
9. How to Unsubscribe or Manage Preferences
You can manage your email preferences in any of the following ways:
- One-click unsubscribe: Every marketing email and property alert email includes an unsubscribe link. Clicking this link immediately removes you from the relevant mailing list.
- Property alert preferences: Alert emails include links to pause alerts, update your search criteria, or permanently unsubscribe.
- Email us: Contact us at compliance@jushavens.com to request removal, update your preferences, or exercise any data right.
Unsubscribe requests take effect immediately. You will continue to receive transactional emails that are necessary for any active service engagement.
